Learn the 6 steps to select and how to name a guardian for your children. One of your most important responsibilities as a parent is to select and legally document guardians for your children. This doesn’t mean just naming godparents or trusting the grandparents will step in if necessary. It means consciously deciding who would raise your children if you cannot. And then it means legally documenting your choices and making sure the people you’ve chosen know what to do if they’re ever called upon.

However, most people have no idea how to even start this process, much less create a legally binding plan. Because of this, many parents simply never get around to doing it. And those who do often make one of several common mistakes—even if they’ve worked with a lawyer.

Why? Because most lawyers haven’t been trained properly to help parents with this vital issue.

As a result, unless you’ve worked with us or another trained Personal Family Lawyer®, it’s likely your children are extremely vulnerable to being taken out of your home and placed in the care of strangers. This might be temporary, while the authorities figure out what to do, or they could end up being raised to adulthood by someone you’d never choose.

Even if you don’t have any minor children at home, please consider sharing this article with any friends or family who do—it’s that important. While it’s rare for something to happen to both parents of a minor child, it does occur, and the consequences are simply too severe to not take a few simple steps to select and legally name guardians the right way.

How To Name A Guardian

1. Define you ideal candidate

The first step in selecting a guardian is to come up with a list outlining the qualities and attributes you and your partner value most when it comes to the long-term care of your children. The list can mirror your own parenting philosophy and style, as well as list the qualities that would make up your absolute “dream” guardian.

In addition to qualities like parental values, discipline style, religious/spiritual background, kindness, and honesty, you also need to consider more practical matters. Is the person young enough and physically capable of raising your kids to adulthood? Do they have a family of their own, and if so, would adding your kids to the mix be too much?

Geography should also come into play—do they live nearby, and if not, would it be a major hardship to relocate your children? Is their home in a location you would feel comfortable having your kids grow up in?

One thing you may think you should consider is financial stability, and that’s a frequent misconception. However, the people you name as legal guardians for your children are the people making decisions for their healthcare and their education, but they don’t need to be the ones managing your children’s financial needs.

Ideally, you’ll leave behind ample financial resources for your children and the people raising them. You can do this by establishing a trust for those resources and naming a financial guardian, or trustee, to oversee them. Please contact us for help with that, as there are many options to consider.

2. Make a list of candidates

Based on those parenting qualities, start compiling a list of people in your life who match your ideals. Be sure to consider not only family, but also close friends.

Though you may feel obligated to choose a family member, this decision is about what’s best for your children’s future, not trying to protect someone’s feelings. And if you’re having trouble coming up with enough suitable candidates, try coming up with people who you would definitely NOT want as guardians, and work backwards from there.

Or consider the person a judge would likely select if you didn’t make your own choice and whether there are any other people you’d prefer to raise your children.

3. Select first responders (temporary guardians)

In addition to legally naming long-term guardians, you also need to choose someone in your local area to be a “first responder,” or temporary guardian. This is someone who lives near you and who’s willing to immediately go to your children during a time of crisis and take care of them until the long-term guardian is notified and appointed by the court pursuant to your long-term guardianship nomination.

If your children are in the care of someone like a babysitter without legal authority to have custody of them, the police will have no choice but to call Child Protective Services and take your children into the care of the authorities. From there, you children could be placed in the care of strangers until your named long-term guardian shows up, or until the court decides on an appropriate guardian.

This is an area where plans that only name a legal guardian through a Will typically fail. Beyond naming just a long-term guardian, you need a short-term, temporary guardian who’s named as the first responder and knows exactly what to do if something happens to you.

Once you’ve chosen your long-term guardian, it’s imperative that all temporary caretakers know exactly how to contact them. This precaution is not just about your death—it also covers your incapacity and any other situation when you’re unable to return home for a lengthy period of time.

Yours, mine and ours … in today’s modern family, it’s oh so common. The blended family is the product of 2nd (or more) marriages, in which one or more of the parties comes with children from a prior marriage. And then, they may even go on to have children together.

If you have or are part of a blended family, it’s important to understand how estate planning could be exactly what you need to keep your family out of conflict and in love, both during life, in the event of incapacity, and when one or more of the senior generation (read: parents) dies.

Let’s begin with understanding where potential conflicts could arise when you have a blended family.

Consider the ones you love

If you have children from a prior marriage, and you become incapacitated or die, leaving everything to your new spouse or partner, there is almost certain to be some conflict (whether spoken or not) between your children and new spouse. Your children may feel unloved, forgotten or resentful.

You may think that this can be avoided by leaving everything to your new spouse or partner, and then on their death, to your children. But this too could set up a scenario where your children feel the need to monitor your spouse/partner’s use of your assets, during their life. And that may not be what you want.

Conversely, you may have a partner or spouse that you have not legally planned for, who you would want to inherit some or all of your assets. But, as things stand right now, your entire estate may go to your children from a prior marriage. This could create a reality where your current partner even gets kicked out of the house you share if something happens to you before your plan is updated.

You can avoid all of this (and even use the estate planning process to build stronger bonds with those you love) by having clear planning in place that has been discussed with your children and your new spouse or partner. We facilitate this as part of the planning process for all blended families.

While the Supreme Court issued a landmark decision to legalize same-sex marriage in the U.S. making it possible for people of all sexual orientations to marry, many modern couples (of all genders and sexual orientation) still choose against marriage. If you’re wondering, “should I legally marry or not?,” read on.

If you are in the inquiry around whether to legally get married, be sure to consider these important factors:

If you are partnered and unmarried, you need financial and legal protections in place, to ensure you and your loved ones are taken care of if you become incapacitated or when you die.

While legally married partners need many of the same financial and legal protections in place, the law does provide some defaults that will provide protection and access to a “legal” spouse that are not given to an unmarried partner.

Imagine this: your partner is hospitalized and you can’t get access because you aren’t married. Or your partner needs a family member to make important legal or financial decisions, but it can’t be you because you aren’t considered a relative without marriage. If you decide you don’t want to get married, do call us to get you the legal documentation you’ll need to validate and protect your rights.

For legally married partners there are default legal provisions providing for a spouse in the event that their spouse dies without a Will in place. While these legal provisions are generally not sufficient or do not match what you would want, at least there is something in place for your spouse. As an unmarried partner though, you would have no legal right to anything belonging to your significant other.

Imagine this: you and your partner live together, but your partner is on the lease or the owner of the home and your partner becomes incapacitated or dies. You could lose your housing while also grieving your partner’s illness or death. Legal documentation can fix this.

When you are considering marriage, remember that legal spouses can file taxes jointly, whereas unmarried couples cannot. And there can be some serious tax savings and benefits that could make marriage quite attractive. Conversely, getting married could negatively impact your tax situation.

Here’s the bottom line: if you are committed to your partner, and want your partner to make legal and financial decisions for you and to have access to some or all of your assets in the event of your incapacity or at the time of your death, whether you get married or not, you need legal and financial planning that ensures your partner has easy access to everything you choose.

The Netflix movie I Care a Lot provides a dark, violent, and somewhat comedic take on the real life and not-at-all funny dangers of the legal (and sometimes corrupt) guardianship system. While the film’s twisting plot may seem far fetched, it sheds light on a tragic phenomenon—the abuse of seniors at the hands of crooked “professional” guardians.

Last week in part one of this series we offered a brief synopsis of the movie, which revolves around Marla Grayson, a crooked professional guardian who makes her living by preying on vulnerable seniors, and we then outlined the true events that inspired the fictional account. The film’s writer and director, J. Blakeson, came up with the idea after reading news stories of a similar scam involving a corrupt professional guardianship agency in Las Vegas.

In that case, a real-life Marla Grayson named April Parks, who owned a company called A Private Professional Guardian, was sentenced to up to 40 years in prison in 2018 after being indicted on more than 200 felonies for using her guardianship status to swindle more than 150 seniors out of their life savings. While I Care a Lot is fictional, the Parks case also inspired the 2018 documentary, The Guardians, directed by award-winning filmmaker Billie Mintz, and his film details the terrifying true events that ravaged the Nevada guardianship industry.

In a Facebook post, Mintz praises I Care a Lot as “a perfect introduction to guardianship,” but worries that because of the movie’s heavy focus on violence and Russian mobsters, “people won’t believe it’s real.” However, as Mintz points out, “I assure you that everything you see about guardianship is true.”

Indeed, while the Parks case is the most famous, similar cases of senior abuse by professional guardians are on the rise across the country. A 2010 report by the Government Accountability Office found hundreds of cases where guardians were involved in the abuse, exploitation, and neglect of seniors placed under their supervision. And given the country’s exploding elderly population and our overloaded court system, such abuse will almost certainly become more common.

Additionally, although most of the cases that have made the news have involved the elderly, the fact is, any adult could face court-ordered guardianship if they become incapacitated by illness or injury and haven’t put the proper legal protections in place.

To this end, here in part two, we’re going to explain how you can protect yourself and your loved ones from such abuse using proactive estate planning.

How It Happens

Should you become incapacitated without any planning in place (due to illness or injury), your family (or a friend) would have to petition the court in order to be granted guardianship. In most cases, the court would appoint a family member as guardian, but this isn’t always the case. If you have no living family members, or those you do have are unwilling or unable to serve or deemed unsuitable by the court, a professional guardian would be appointed.

Beyond the potential for abuse by professional guardians, if you become incapacitated and your family is forced into court seeking guardianship, they are likely to endure a costly, drawn out, and emotionally taxing process. Not only can the legal fees and court costs drain your estate, but if your loved ones disagree over who is best suited to serve as your guardian, it could cause a bitter conflict that could tear your family apart and make it less likely that you get the kind of care you want.

In another scenario, should your loved ones disagree about who should be your guardian, the court could decide that naming a relative as your guardian would be too disruptive to your family dynamics and appoint a professional guardian instead. However, if you have the proper planning vehicles in place, it is highly unlikely for a guardian to be appointed against your wishes.

A Comprehensive Plan For Incapacity

Should you become incapacitated, a comprehensive incapacity plan would give the individual, or individuals, of your choice the immediate authority to make your medical, financial, and legal decisions, without the need for court intervention. Moreover, such planning allows you to provide clear guidance about your wishes, so there is no mistake about how these decisions should be made.

There are several planning vehicles that can go into a comprehensive plan for incapacity, but a will is not among them. A will only goes into effect upon your death, and then, it merely governs how your assets should be divided, so it would do nothing to protect you in the event of incapacity.

When it comes to creating your incapacity plan, your best bet is to put in place a number of different planning tools rather than a single document. To this end, your plan should include some or all of the following:

Durable financial power of attorney: This document grants an individual of your choice the immediate authority to make decisions related to the management of your financial and legal affairs.
Revocable living trust: A living trust immediately transfers control of all assets held by the trust to a person of your choice to be used for your benefit in the event of your incapacity. The trust can include legally binding instructions for how your care should be managed, and the document can even spell out specific conditions that must be met for you to be deemed incapacitated.
Medical power of attorney: A medical power of attorney grants an individual of your choice the immediate legal authority to make decisions about your medical treatment in the event of your incapacity.
Living will: A living will ((sometimes called an advance directive) provides specific guidance about how your medical decisions should be made during your incapacity, particularly at the end of life. In some instances, a medical power of attorney and a living will are combined in a single document.

But here is the thing about all of these documents—they are just documents and not guidance for the people you love. If you really want to keep your family and friends out of court and out of conflict, you cannot just rely on documents to do it. Rather, these documents should be created by a lawyer who will get to know you, your wishes, and be there for you throughout the many stages of life, plus be there for your family and friends if and when you can’t be.

Communication is Key

In addition to the above planning tools, it is equally—if not more—important for your loved ones to be aware of your plan and understand their role in it. As part of our planning process, we hold a family meeting with all of the individuals impacted by your plan where we walk them through your plan and explain the reasoning behind your decisions and what they need to do if something happens to you.

By combining your comprehensive incapacity plan with a team of people who care for you, can watch out for you, and know exactly what to do in the event tragedy strikes, we can make it virtually impossible for you to be abused by a professional guardian.

Don’t Put It Off

Although incapacity from dementia is most common in the elderly, debilitating injury and illness can strike at any point in life. Given this, all adults 18 and older should have an incapacity plan. Furthermore, planning for incapacity must take place well before any cognitive decline appears, since you must be able to clearly express your wishes and consent for the documents to be valid.

In light of this, you should get your own planning handled first, and then discuss the need for planning with your aging parents as soon as possible, and from there, schedule a Family Wealth Planning Session with us to get a plan started. Unfortunately, a plan put in place years ago is unlikely to work now, so updating is critical, and unfortunately often not overlooked.

You can find all of that—and just about anything else—with a quick Google search. Indeed, the amount of information you can gain from the Internet is staggering. But just because you can find something online doesn’t mean you should trust it.

This caveat is especially true when it comes to legal documents for your business. While you’ll find tons of websites offering click-and-print legal forms for dirt cheap, these do-it-yourself (DIY) documents can put your business in serious peril.

You get what you pay for

With so many important items needed to run a business, it’s easy to give less priority to what seem like cut-and-dry legal documents. To the layperson, many standard business agreements appear basically identical, only with different names and numbers depending on whom you’re dealing with.

However, when it comes to legally binding contracts, the details of each agreement are of paramount importance. Even the smallest mistake or omission can make the contract invalid or seriously affect its enforcement. What’s more, without a legal background, you’ll have no idea what to look for to catch and correct such errors.

Sure, such forms are often less expensive than hiring a lawyer in the short run. But is saving a few hundred dollars actually worth the very real potential that down the road you’ll get stuck paying tens of thousands of dollars in attorney’s fees, fines, and court costs—or even going out of business?

If you want to see how truly ineffective DIY legal documents can be, look no further than the fine print found in the document websites themselves. These companies flat out tell you that at best, their products are inferior to the advice of a lawyer, and at worst, completely ineffective.

The information, software, products, and services made available through Rocket Lawyer® may include inaccuracies or typographical errors. Information received via Rocket Lawyer® should not be relied upon for personal, medical, legal, or financial decisions.

When even the companies themselves admit that you can’t trust their products to be accurate, effective, or reliable, that should be a huge red flag. After all, isn’t getting accurate, effective, and reliable legal documents the whole reason you’re doing business with them in the first place?

A false sense of security

These online document companies are counting on you to believe that technology has reached a point where consulting with a live lawyer is no longer a necessity. Yet their own terms and conditions totally dispel this dangerous assumption.

And this leads to perhaps the most egregious thing about online legal document services—they provide business owners with a false sense of security. Thinking that DIY forms provide your business with a solid legal foundation can be tremendously dangerous, especially if they prevent—or delay—you from consulting with a real lawyer.

While you may be able to cut corners in other areas of your business, not having effective legal systems is a disaster waiting to happen.

If you purchase a cut-rate computer printer, for example, and it misprints some of your office memos, that’s problematic, but not exactly devastating. However, if the legal agreements you rely on are incorrect, outdated, or faulty in any way, it can put your entire company in jeopardy.

Legal documents are designed to protect some of your business’ most essential elements: your personal liability, intellectual property, trade secrets, and tax obligations to name just a few. Are you really going to trust generic, fill-in-the-blank forms you found online to protect such vital components of your business?

Don’t do it yourself

From wildfires in California and hurricanes in Texas to floods in West Virginia, hardly any area of the U.S. is immune from the threat of natural disasters. And according to a report released by the government regarding climate change and its impact on Black Friday, it’s only going to get worse. Despite this threat, many homeowners still lack the insurance needed to protect their property and possessions from such catastrophes.

In fact, roughly two-thirds of all homeowners are underinsured for natural disasters, according to United Policyholders (UP), a nonprofit organization for insurance consumers. One contributing factor to this lack of coverage is the mistaken belief that homeowners insurance offers protection from such calamities. In reality, natural disasters are typically not covered by standard homeowners policies.

In order to obtain protection, you often need to purchase separate policies that cover specific types of natural disasters. Here, we’ve highlighted the types of insurance coverage available and how the policies work.

Wildfires

While homeowners insurance typically doesn’t pay for damage caused by natural disasters, most policies do protect against fire damage, including wildfires like the recent ones in California. The only instances of fire damage homeowners policies won’t cover are fires caused by arson or when fire destroys a home that’s been vacant for at least 30 days when the fire occurred.

That said, not all homeowners policies are created equal, so you should check your policy to make certain that it includes enough coverage to do three things: replace your home’s structure, replace your belongings, and cover your living expenses while your home is being repaired, known as “loss of use” coverage.

In certain areas that are extremely high-risk for wildfires, it can be be difficult to find a company to insure your home. In such cases, you should look into state-sponsored fire insurance like California’s FAIR Plan.

Earthquakes

Unlike fires, earthquakes are typically not covered by homeowners policies. To protect your home against quakes, you’ll need a freestanding earthquake insurance policy. And contrary to popular belief, Californians aren’t the only ones who should be worried.

Most parts of the U.S. are at some risk for earthquakes. Indeed, the U.S. Geological Survey found that between the 20 years from 1975 to 1995 earthquakes occured in every state except Florida, Iowa, North Dakota, and Wisconsin. To gauge the risk in your area, consult with the Federal Emergency Management Agency’s (FEMA) earthquake hazard map.

While earthquake insurance is available practically everywhere, policies in high-risk areas typically come with high deductibles, ranging from 10% to 15% of the home’s value. What’s more, though earthquake insurance covers damage directly caused by the quake, some related damages such as flooding are likely not covered. Carefully review your policy to see what’s included—and what’s not.

Floods

Though homeowners insurance generally covers flood damage caused by faulty infrastructure like leaky pipes, nearly all policies exclude flood damage caused by natural events like heavy rain, overflowing rivers, and hurricanes. You’ll need stand-alone flood insurance to protect your property and possessions from these events.

The threat from flooding is so widespread, Congress created the National Flood Insurance Program (NFIP) in 1968, which allows homeowners in flood-prone areas to purchase flood insurance backed by the U.S. government. In some coastal regions, especially where hurricanes are prevalent, you might even be required to buy flood insurance. To determine the risk for your property, consult FEMA’s Flood Map service center.

Even if you live in a location where flood insurance isn’t required, you may want to consider buying it anyway. Indeed, 90% of all natural disasters include some form of flooding, and more than 20% of flood-damage claims come from properties outside high-risk flood zones.

Hurricanes and tornadoes

Most homeowners policies do offer coverage for wind-related damage. However, it depends on the type of storm that caused the damage. For example, wind damage from tornadoes and even some tropical storms is typically covered, but wind damage from hurricanes generally requires a separate windstorm policy, or in some cases, a hurricane rider.

Because damage from hurricanes is often measured in the billions, these windstorm policies usually have higher deductibles that are often based on a percentage of your home’s value, instead of a fixed dollar amount. Some policies also come with a cap on coverage, so be sure to review exactly what type and amount of coverage your policy offers.

Of course, high winds aren’t the only threat posed by hurricanes. Such tropical systems can also cause severe flooding, which is frequently the storm’s most damaging element. But as mentioned before, whether it’s caused by a hurricane or a tornado, flooding is not generally covered by homeowners insurance. For flood protection, you’ll need to purchase a separate flood insurance policy through the NFIP.
